Legally Responsible Individuals (LRIs)

DMAS received federal approval to extend some of the current processes for paying legally responsible individuals (LRI)s. This extension will support families while changes to the program policies are being discussed in the General Assembly. The only changes that will go into effect on March 1, 2024, are those which have fiscal impacts. DMAS will implement the following on March 1, 2024:

  1. LRI payments will be limited to 40 hours per week. LRIs are permitted to find other caregivers for the additional hours approved in the plan of care.
  2. Respite will not be available when there is a paid LRI.

All other provisions will be delayed until the General Assembly makes a final decision. Any directions from the General Assembly will be implemented when the Department submits amendments to CMS for those changes.
